Banking consumers in India are protected by strict regulations established by the Reserve Bank of India (RBI). Whether it is a failed ATM cash withdrawal where your account was debited, or an unauthorized credit card charge, the RBI mandates specific turnaround times (TAT) and defines monetary compensations for bank deficiencies.
1. Failed ATM Transactions (T+5 Rule)
A common banking dispute occurs when you attempt to withdraw cash from an ATM, the cash is not dispensed, but your bank account is debited.
- Auto-Reversal Timeline: Under RBI rules, the bank must credit the failed transaction amount back to the customer's account within 5 calendar days (T+5 days, where T is the day of the transaction).
- Daily Compensation Penalty: If the bank fails to credit the amount within 5 days, they must pay a penalty of ₹100 per day of delay to the consumer. This penalty is paid automatically without the consumer filing a separate claim.
2. Unauthorised Electronic Transactions (Zero Liability Rule)
If money is stolen from your account via online banking, mobile apps, or cloned debit cards:
- Zero Liability: If you notify the bank of an unauthorized transaction within 3 working days of receiving the alert, your liability is zero. The bank must credit the disputed amount within 10 working days.
- Limited Liability: If reported between 4 to 7 working days, your liability is capped (e.g., maximum ₹10,000 for basic savings accounts).
- Beyond 7 Days: Customer liability is determined as per the board-approved policies of the bank.
3. Step-by-Step Banking Dispute Process
- Report Instantly: Call the bank’s emergency card-blocking helpline to block mobile banking/cards.
- Submit Formal Grievance: Submit a written complaint or log a ticket on the bank's portal (SBI, HDFC, ICICI, etc.). Get a complaint number.
- Escalate to Principal Nodal Officer (PNO): If the customer care agent doesn't resolve it within 7 days, escalate to the PNO of the bank.
- RBI CMS Portal: If unresolved after 30 days, file a case on cms.rbi.org.in.
